Grant of Prosecution Sanction in the case of Contractual Employees

Haryana Government has issued latest instructions regarding grant of prosecution sanction in the cases of contractual employees. According to the instructions issued by tha State Govt. it has been observed that prosecution sanction against contractual employees (engaged under Outsourcing Policy Part-1 & II) accused under the Prevention of Corruption Act, 1998 has sometimes not been issued by the authorities concerned on the ground that department is not competent to grant prosecution sanction and only Outsourcing agency/service provider/contractor can/could remove them.

Now, the matter has been considered and it has been decided that the Head of the Department or Head of the office (in-charge of indent organisation concerned) who approved the entering into service agreement with service provider. or the Head of Office under whose approval employees were hired under Outsourcing Policy Part-ll is competent authority to grant prosecution sanction in such cases.
